Terms of Service
These terms apply to approved workshops, their authorised users, and visitors using Workshop HQ.
1. Provider and acceptance
Workshop HQ is a business name operated by EA Performance Group Pty Ltd, ABN 80 700 625 878. By accessing the platform, creating or using an approved account, or continuing to use a paid or trial service, you agree to these terms and the Privacy Policy. If you use Workshop HQ for a business, you confirm that you are authorised to accept these terms for that business.
2. Accounts and authorised use
- Workshop accounts are approval-only unless Workshop HQ enables another onboarding method.
- You must provide accurate information and protect account credentials and MFA devices.
- Each user must use their own account and must have an appropriate workshop role.
- You must promptly disable access for people who no longer require it.
- You must not bypass security controls, disrupt the service, scrape it, introduce malicious code or use it unlawfully.
3. Workshop data and responsibilities
The workshop retains ownership of the business and customer data it provides. The workshop authorises Workshop HQ and its service providers to process that data to operate, secure, support and improve the service. The workshop is responsible for the accuracy and lawfulness of its data, user permissions, customer notices and consents, communications, tax treatment, invoices, mechanical advice and decisions made using the platform.
Workshop HQ is workflow software. It does not provide mechanical, accounting, tax, legal or financial advice and does not replace professional judgment.
4. Subscriptions, trials and payment
The applicable plan, trial period, fees, billing cycle and included limits will be agreed during onboarding or shown in the workshop's billing settings. Unless otherwise agreed, fees are in Australian dollars and exclude GST. We may suspend paid access after reasonable notice if an undisputed amount remains overdue. Plan or price changes apply only after notice and will not remove rights that cannot lawfully be excluded.
5. Availability, changes and support
We aim to provide a reliable service but do not promise uninterrupted availability. Planned maintenance, provider outages, security incidents or urgent repairs may affect access. We may improve, replace or retire features, and will give reasonable notice where a material change is likely to adversely affect paid use. Support is available at [email protected].
6. Suspension and termination
A workshop may stop using the service and request account closure. We may suspend or end access for serious or repeated breaches, security risk, unlawful use, non-payment or where continuing the service would expose users or Workshop HQ to material harm. Where reasonable, we will provide notice and an opportunity to remedy the issue. Data export and deletion are subject to the plan, lawful retention requirements, backup cycles and the Privacy Policy.
7. Consumer guarantees and liability
Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Subject to those rights, each party is responsible for loss it causes through breach, negligence or unlawful conduct. To the extent permitted by law, Workshop HQ is not responsible for indirect or consequential loss, lost opportunity, or loss caused by inaccurate workshop data, third-party services, unauthorised credentials or use contrary to these terms.
8. General
These terms are governed by the laws of Queensland, Australia. The parties will first try to resolve disputes in good faith. If part of these terms is unenforceable, the remaining terms continue. We may update these terms for legal, security or product reasons and will give reasonable notice of material changes affecting paid workshops.
